In accordance with schedule 12, para 10(2) of the Local Government Act 1972 Notice is herby given that a meeting of Lydiard Millicent Parish Council will be held on Thursday, 4th January 2018 in the Parish Hall, Lydiard Millicent, commencing at 7.30pm.

Public Question Time: Members of the public are invited to make representations to Lydiard Millicent Parish Council on any matters relating to this Agenda (Public Bodies [admission to meetings] Act 1960), limited to 10 minutes. Every effort will be made to give accurate answers to all questions, but in some cases further research may be necessary when an answer will be given by the Chairman or Clerk as soon as possible.

Report from Wiltshire Council: An opportunity to receive information from, or put questions to, the local Unitary Councillor Mollie Groom.

Statement from Andrew Harris who has given notice he wishes to resign from Lydiard Millicent Parish Council.

AGENDA


1. Election of Chairman: In order for a Parish Council to be properly constituted it must have a chairman (LGA 1972 s 14). No further business can be transacted until a chairman has been elected, and accepted that position.

Councillors will be asked to nominate a person for consideration from within the Council. A vote by show of hands will then take place. If there is an equality of votes the chairman must make a casting vote (LGA 1972 s 15[3]).

Members are requested to nominate a person from within their number to act as a chairman until May 2018.

Declaration of Acceptance of Office: The newly elected chairman will be invited to sign their acceptance of office; this will be witnessed by the Proper Officer of the Council.

Election of Vice Chairman: If, due to election of chairman, the seat of vice chairman becomes vacant members will be asked to consider nominations for this position. The same process will be used as for the election of chairman above


2. Apologies for Absence: The Council is asked to note any apologies and to accept reasons they consider to be appropriate.


3. Declarations of Interest: To receive Declarations of Interest in accordance with the Code of Conduct adopted by this Council in July 2012. Members are
reminded that it is their personal responsibility to keep entries in the Register of Interests up to date; please contact the clerk, if in need of updating.


4. Minutes: To confirm, adopt and sign as a true record, Minutes of the Meeting held on Thursday 7th December 2017.

5. Finance - Appendix A
The Council is asked to ratify the payments contained in the Finance Report for December. Two Councillors have previously scrutinised and signed cheques for
these accounts. Report will follow later.


6. Planning Matters
a) The Council is asked to note the following decisions made by Wiltshire Council since the last meeting:


• 17/10116/FUL – 28 Stone Lane, Lydiard Millicent
Proposed dormer (retrospective).
Decision : Approve with Conditions


• 17/10915/TCA –Lydiard Millicent C of E Primary School
Reduce branches overhanging in car park.
Decision : No Objections


b) The Council is asked to confirm the Planning Working Group recommendations on the following Planning Applications from Wiltshire Council.


Recommendations: No Planning Applications have been received from Wiltshire Council for consideration at this meeting.


8. Annual Estimates of Income and Expenditure -  Appendix B


Councillors are advised that the effect of section 106 of the Local Government Finance Act 1992 is that if, when considering budgetary items, any Councillor is
in arrears for more than two months with his/her Council Tax, he/she must declare that section 106 of the Local Government Finance Act 1992 applies and neither speak nor vote on the matter before Council. Failure to observe this renders the Councillor liable for prosecution by the Director of Public Prosecutions.

It is the responsibility of the Parish Council to levy a precept on Wiltshire Council to cover its costs for the following financial year; this levy can only be requested
once per year. Wiltshire Council is the charging authority and will collect this on behalf of the Parish Council. Details must be with Wiltshire Council no later than
19th January 2018.


In order for a precept to be levied the Council must first set a budget; details of the draft budget are attached. The Council will be asked to consider its budgetary
requirements for 2018-19 and then to decide on the precept it wishes to levy. It should also be noted that there will not be a cap on increases to Parish Council
taxes for the next three years; the Government will review the situation again hopefully before 2021-22 budgets are prepared.


The Council is asked to consider the proposed draft budget report and to authorise the amount of tax to be collected on its behalf by Wiltshire Council.


9. Working Groups (WG) and Reps for Outside Bodies
Members are reminded that Working Groups can only recommend to the Council, under the Councils current Standing Orders decisions must be made by the Full Council. For a legally binding decision to be made Councillors, and members of the public, must be aware of the decision about to be taken, ie details must be included on an agenda, and notified at least three days prior to a meeting.


10. Communications
The Clerk will report on any extra-ordinary issues from the preceding month, and ask members to consider items they wish to be actively promoted during the
coming month, by way of Press Releases or Notices.


11. Comments / Observations from Social Media sites
Members requested that an item be added to the Agenda to acknowledge comments made on Social Media sites or via e-mail. This item is for information
sharing only; if individual Members wish an issue to be considered further they should make contact with the resident for further discussion in the first instance.


12. Date of Next Meeting
The next ordinary meeting of Lydiard Millicent Parish Council will take place on Thursday 1st February 2018 at Lydiard Millicent Parish Hall, commencing at
7.30pm.
